Notice to Client
Ohio's Mechanic's Lien Law is complex and it is recommended that you consult an attorney.
Terms of Payment
Payments are due within 10 days of receipt of invoice. In the event of late payment, past due balances will incur a late fee of $25.00 and a re-billing fee of $25.00 per month until the invoice is paid in full. Failure to make timely payment may result in suspension of services and may void any applicable
warranties.
Deposit & Cancellation Policy
All landscaping installation or enhancement work requires a 50% deposit upon approval of the quote. Work will not be scheduled until the deposit has been received.
Cancellations within three (3) days of quote approval will receive a full refund of any deposit paid, provided that materials have not been ordered and work has not begun.
Cancellations made after three (3) days of approval will result in a $350.00 cancellation fee.
Cancellations during the week the job is scheduled will result in a cancellation charge of $350.00 or fifty percent (50%) of the deposit, whichever amount is greater. If materials have already been purchased for the project, the Client will be responsible for the full cost of those materials.
Changes
Any alterations or deviations from the agreed specifications involving extra costs will only be performed upon a signed written change order. Payment for approved changes may be required in advance.
Contract Time
All completion dates are estimates. Blades of Grass Landscaping is not liable for delays due to weather conditions, labor issues, accidents, material shortages, or other circumstances beyond our control.
Escalation Clause
Any delays or market conditions affecting the cost of materials, plants, soil, or labor may result in price adjustments to reflect increased costs.
Responsibilities
The Client is responsible for providing access to the work area and for identifying underground utilities or hazards. Blades of Grass Landscaping is not responsible for damage to underground utilities or structures not properly marked through Ohio Utilities Protection Service (OUPS) or otherwise disclosed.
Warranty
Blades of Grass Landscaping warrants newly installed plants for one (1) year when the company performs monthly maintenance services. Without monthly maintenance, plant warranty is limited to thirty (30) days. Seasonal flowers are excluded from warranty.
Lawn Service Disclaimer
Weekly lawn services typically run from mid-April through mid-November depending on weather conditions. Weather delays may occur, and services will be performed on the next suitable day when conditions allow.
Snow Removal Services
Quotes are based on initial property conditions and expected snowfall patterns. Multiple service visits may be required during storms to maintain safe property conditions.
Extreme Weather / Excessive Snowfall Events
Snow removal pricing is based on historical weather patterns and average seasonal snowfall totals. During unusually heavy snowfall, extended winter storm activity, or prolonged freezing conditions that significantly exceed seasonal averages, Blades of Grass Landscaping reserves the right to implement pricing adjustments or additional service charges due to increased service visits or material usage.
De-Icing Material Supply & Pricing Adjustment
Blades of Grass Landscaping reserves the right to adjust pricing during periods of shortages or abnormal cost increases for salt or de-icing materials. Temporary surcharges or revised pricing may be implemented when necessary to maintain safe property conditions.
Salt Allocation & Material Availability
In the event that suppliers limit or allocate salt or de-icing material deliveries, Blades of Grass Landscaping reserves the right to allocate available materials at its discretion and prioritize high-risk areas such as entrances, driving lanes, loading areas, and walkways.
Snow & Ice Risk Acknowledgement
Snow and ice management services are intended to reduce hazards but cannot eliminate all risks associated with winter weather. Surfaces cannot be guaranteed to be completely snow or ice free, particularly during active storms or changing weather conditions.
Retainer or Package Programs
If a retainer or package program is selected, no refunds or service credits will be provided if Blades of Grass Landscaping does not service the property the established number of visits as determined by the plan due to lack of snowfall.
Payment Terms for Snow Services
Snow removal invoices are issued monthly, with payment due within 30 days for commercial clients and within 15 days for residential clients. Late fees of $25.00 per month and a $25.00 re-billing fee per month apply to overdue invoices until paid in full. Services may be suspended if balances remain
unpaid. Payments for snow removal are non-refundable, and no service credits are provided for milder winters or fewer service visits than anticipated.
Salt & De-Icing Material Disclaimer
Blades of Grass Landscaping is not responsible for the corrosive effects of de-icing materials, including potential pitting of concrete surfaces or impacts on plant materials.
Governing Law
All services and disclaimers related to snow removal are governed by the laws of the State of Ohio. Any disputes shall be resolved within a court of competent jurisdiction located in Lorain County or Cuyahoga County, Ohio.
Acceptance of Terms
By accepting any lawn, landscaping, or snow removal service, the Client agrees to all terms and conditions outlined in this document.
